Debra has been named a Tech Titan by the San Antonio Business Journal and a VIP Geek by Geekdom. WOAI has called her one of the top Internet and cyber lawyers in the state. She maintains a diverse transactional and litigation practice for emerging companies in the technology and Internet-related industries, and she uses her tech acumen to assist non-tech clients navigate the complex, new-world legal issues presented by emerging technologies. Prior to her legal career, she was a professor at St. Mary’s University.

In connection with her corporate practice, Debra counsels entrepreneurs on start-up ventures, including entity selection and formation, financing, IP protection, and data monetization.  For existing and scaling businesses, she assists with compliance and commercial transactions related to e-commerce, data privacy and security, data management and cloud migration, social media, and electronic marketing and e-communication.

Debra brings practical technological tools to bear in her litigation practice, effectively managing dockets of hundreds of lawsuits throughout the country by streamlining processes and consolidating data to help clients make smart, informed decisions. She assists clients and other lawyers navigate e-discovery and computer forensics, which in today's data-rich era of mobile devices and the Internet of Things ("IoT") can be critical to obtaining successful outcomes in litigated matters.  She also defends clients' rights in technology-related litigation, including such new areas as cyber defamation, cyber bullying, and online harassment.

 
EXPERIENCE

Technology Transactions
  • Preparing terms of use, terms of sale, and privacy policies for websites and apps;
  • Negotiation of enterprise resource planning (ERP) agreements for small businesses to Fortune 500 companies, including infrastructure-as-a-service (IaaS), platform-as-a-service (PaaS), and software-as-a-service (SaaS) systems as well as service level agreements (SLA) and end-user agreements (EULA);
  • Dispute resolution of copyright infringement claims related to social media;
  • Resolution of domain name disputes under the Uniform Domain Name Dispute Resolution Policy (UDRP) and Anticybersquatting Consumer Protection Act (ACPA);
  • Cease and desist letters and take-down disputes under the Digital Millennium Copyright Act (DMCA);
  • Negotiating website development agreements to protect intellectual property ownership;
  • E-commerce compliance, including electronic and digital signatures, electronic contracting, and electronic payment systems;
  • Data breach response and mitigation.

Startup and Entrepreneur Transactions
  • Strategy for entity selection and formation;
  • Counseling for and negotiation of seed rounds, including convertible notes and SAFEs;
  • Intellectual property protection, including trademark screening and applications, both domestic and international;
  • Data privacy analysis including prospective strategy for data monetization;
  • Creative clearance, including review of websites and social media for infringement issues.

Litigation and Dispute Resolution
  • Management of national litigation dockets for Fortune 100 company, including coordination of local counsel, implementation of reporting and resolution protocols, and development of research, best-practices, and template e-portal for streamlined handling of litigation processes;
  • Formulation of e-discovery and computer forensics strategy for complex litigation;
  • Management of discovery in complex lawsuit for international mining company with document count in the multi-millions;
  • Strategy and counsel for non-litigation resolution of data breach incidents; and
  • Defense and prosecution of cyber defamation and harassment;
